This course will introduce students to the role, legal structures, and practice of international arbitration. Topics to be covered include drafting and enforcement of arbitration agreements, the role of the seat of arbitration and its laws, appointment and challenge of arbitrators, interim measures, confidentiality, pre-hearing procedures and evidence-gathering, and recognition and enforcement of awards. The course will cover international commercial and investor-state arbitration, with a focus on the intersection of international law, national law, and private contract that comprises the governing regime for this important means for the resolution of international disputes.
